1. These terms
These Terms of Service govern your use of pheronia.com and every order you place through it. By using the site or placing an order you accept them. If you do not accept them, please do not order.
Our Shipping Policy, Refund Policy, Privacy Policy and Legal Notice form part of these terms. Where a policy says something more specific than this page, the policy wins.
2. Who we are
Pheronia is operated by Ganser Business Management LLC, a limited liability company registered in the State of Florida, United States, at 7901 4th St N, #8852, St. Petersburg, FL 33702, United States of America. In these terms, "we", "us" and "our" mean that company. "You" means the person placing the order.
3. Who may order
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. By ordering you confirm that you are.
4. The products, and what they are not
We sell calming products for cats and dogs that work with synthetic pheromone analogues. They are everyday comfort products for the home.
They are not medicines, not veterinary medicinal products, and not a treatment for any condition. Nothing on this site is veterinary advice, and nothing we sell is intended to diagnose, treat, cure or prevent a disease. Animals differ, and no calming product works for every animal, which is exactly why we offer the thirty-night guarantee instead of a promise.
If your pet is unwell, suddenly changes behaviour, stops eating or stops using the litter box, see a veterinarian. Use our products as described on the packaging and on the product page, keep them out of reach of children, and do not apply anything directly to an animal unless the label says to.
5. Prices, currency and tax
All prices are in US dollars and are the prices in force at the time you order. We can change prices at any time, but never for an order already placed. Sales tax is added at checkout where we are required to collect it. Import duties and taxes are covered in the Shipping Policy.
We do everything we reasonably can to keep prices and descriptions accurate. If an item is listed at an obviously wrong price or is described incorrectly, we may cancel the affected order and refund it in full before it ships, and we will write to you and explain.
6. Your order
Your order is an offer to buy. The confirmation email we send is an acknowledgement that we received it, not yet an acceptance. The contract is formed when we send you a shipping confirmation.
We may decline or cancel an order, in whole or in part, where an item is out of stock, where a price or description was wrong, where we cannot ship to your address, where an order looks fraudulent, or where quantities suggest resale rather than personal use. If we do, we refund you in full and tell you why.
7. Payment
Payment is taken at checkout through Shopify's payment providers. We never see or store your full card details. If your payment is declined or reversed before we ship, we may cancel the order.
8. Shipping and delivery
Delivery times, costs, split shipments, customs duties and what happens if we cannot ship in time are set out in full in our Shipping Policy. Risk in the goods passes to you on delivery.
9. Guarantee, returns and refunds
Our thirty-night guarantee and everything about returns and refunds, including the statutory withdrawal right for orders delivered in the EU and the UK, is set out in our Refund Policy.
10. Your account
You do not need an account to order. If you create one, keep your password to yourself and tell us if you think someone else has it. You are responsible for what happens under your account.
11. Reviews and anything else you send us
We publish customer reviews only from people who actually bought the product. We do not buy reviews, we do not import them from other sellers, we do not generate them, and we do not offer anything in exchange for a positive one. We publish the critical ones as well as the good ones, and we do not edit the substance of a review.
When you send us a review, a photo or a video, you keep ownership of it and give us a non-exclusive, worldwide, royalty-free licence to show it on our site, in our emails and in our advertising. You confirm it is your own work, that it is truthful, and that anyone shown in it agreed to that. We may decline or remove content that is abusive, unlawful, off-topic, or written by someone who did not buy the product.
12. How you may use the site
Please do not attempt to break into the site, scrape it at a scale that degrades it, copy it to build a competing shop, upload anything malicious, or use it for anything unlawful. We may suspend access where any of that happens.
13. Our content and trademarks
The text, images, layout, code and branding of this site belong to us or are used under licence, and are protected by copyright and trademark law. You may view, print and share pages for your own personal use. Any commercial reuse needs our written consent. Other companies' brand names that appear here belong to them and are used descriptively.
14. Links and third-party services
The site links to third-party pages such as published studies and carrier tracking, and it runs on third-party services including Shopify. Those services have their own terms, and we are not responsible for their content or availability.
15. Emails from us
If you ask for our emails or place an order, we may send you order updates and marketing emails. Every marketing email has a one-click unsubscribe link and our postal address, and unsubscribing takes effect promptly. Order and service emails are not marketing and continue regardless.
16. Accessibility
We want this site to be usable with a screen reader, a keyboard and a magnifier, and we work towards the WCAG 2.1 Level AA standard. If something here gets in your way, write to us, tell us what you were trying to do, and we will fix it and help you complete your order in the meantime.
17. Warranties
We provide the site and its content as they are. Beyond the guarantee in our Refund Policy and any warranty that the law gives you and that cannot be excluded, we make no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
18. Liability
To the fullest extent the law allows, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profit, lost data, or loss arising from a delay in delivery. This does not affect the rights consumers have under mandatory local law, which we do not attempt to exclude.
19. Events outside our control
We are not in breach of these terms where performance is prevented or delayed by something outside our reasonable control, including customs action, carrier failure, extreme weather, strikes, or a supplier shutdown. Where a delay affects your order, the 30-day rule in our Shipping Policy applies and you can cancel for a full refund.
20. Sorting out a problem
If something goes wrong, email us first at ganserbusinessmanagement@gmail.com and give us 30 days to put it right. Most disputes end there. This step is a condition of starting formal proceedings, unless the law where you live says otherwise.
21. Governing law
These terms and any dispute arising from them are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. The courts located in Pinellas County, Florida have jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in your local courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
22. Changes to these terms
We may update these terms, for example when the law changes or we change how we ship. The version in force when you place an order is the version that applies to it. The date below shows when we last changed anything.
23. The rest
If a court finds part of these terms unenforceable, the rest stays in force. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms without our consent; we may transfer ours if the business is sold, without affecting your rights. These terms, together with the policies linked from them, are the whole agreement between us.
